These Terms of Service govern your use of the Emboxed website and your engagement with Emboxed as a gifting service. By using this website or engaging Emily Berg for a gifting project, you agree to these terms. If you do not agree, please do not use this site or engage our services.

Emboxed is operated by Emily Berg as a sole proprietorship. References to "Emboxed," "we," "us," or "Emily" throughout these terms refer to Emily Berg doing business as Emboxed.

Use of This Website

You may use this website for lawful purposes only. You agree not to use this site in any way that could damage, disable, or impair the site or interfere with any other party's use of it. You agree not to attempt to gain unauthorized access to any part of the site or its related systems.

The content on this website — including all text, photography, design, and branding — is the property of Emboxed and may not be copied, reproduced, or distributed without written permission.

Inquiries and Consultations

Submitting an inquiry through the Work With Emily form or contacting us by email does not create a binding agreement or guarantee availability. Emily reviews all inquiries personally and will follow up within 24 to 48 business hours. The initial consultation is complimentary and carries no obligation on either side.

Project Agreements

When you move forward with a gifting project, the specific terms of that engagement — including scope, pricing, timeline, payment terms, and deliverables — will be outlined in a written proposal or agreement provided by Emily. Those project-specific terms govern that engagement and take precedence over these general Terms of Service in the event of any conflict.

Pricing and Payment

Pricing for each project is determined based on the products selected, level of customization, and order quantity. Emily provides a transparent, itemized proposal before any work begins. There are no hidden fees.

Payment terms are outlined in your project proposal. In general, Emboxed requires a deposit before production begins, with the remaining balance due prior to shipment. Accepted payment methods will be specified in your proposal. Emboxed can issue invoices compatible with most corporate accounts payable processes.

Custom and Branded Products

Projects involving custom branding — including laser etching, printed packaging, embroidered apparel, or other personalized items — require client approval of designs before production begins. Once production has started on custom or branded items, those items cannot be returned, exchanged, or refunded. It is the client's responsibility to review and approve all proofs carefully before confirming production.

Cancellations and Changes

If you need to cancel or significantly change a project after a proposal has been accepted and a deposit paid, please contact Emily as soon as possible. Cancellation and change policies depend on how far into production the project is at the time of the request. Deposits are generally non-refundable once sourcing or production has begun. Emily will always be straightforward about what can and cannot be accommodated given the project timeline.

Shipping and Delivery

Emboxed manages all packaging and logistics on your behalf. Estimated delivery timelines are provided as part of your project proposal. While we take every reasonable step to ensure on-time delivery, we cannot be held responsible for delays caused by carriers, weather events, incorrect addresses provided by the client, or other circumstances outside our control.

If a shipment is undeliverable or returned due to an incorrect address provided by the client, the cost of reshipping is the client's responsibility. If a shipment is lost or damaged in transit, Emily will work with you to find a practical resolution.

Client Responsibilities

To allow Emboxed to complete your project successfully, you agree to:

  • Provide accurate and complete information about recipients, addresses, and project requirements
  • Review and approve proofs and proposals in a timely manner
  • Communicate any changes or concerns promptly
  • Make payments according to the agreed terms

Delays caused by late approvals, late payments, or incomplete information provided by the client may affect the project timeline, and Emboxed cannot be held responsible for delays resulting from these circumstances.

Intellectual Property

Any logos, brand assets, or other materials you provide to Emboxed for use in your project remain your property. By providing them, you represent that you have the right to use them and to authorize us to use them on your behalf for the purposes of your project. Emboxed will not use your brand assets for any purpose beyond fulfilling your project.

Confidentiality

Emboxed treats all client information — including recipient lists, project details, brand standards, and business relationships — with discretion. We do not discuss client projects publicly or share client information with parties not involved in fulfilling your project. We ask that clients extend the same respect to any proprietary information, pricing, or sourcing relationships shared by Emboxed in the course of a project.

Limitation of Liability

Emboxed provides gifting curation and fulfillment services with care and attention to quality. However, to the fullest extent permitted by law, Emboxed is not liable for any indirect, incidental, or consequential damages arising from your use of this website or from a gifting project, including but not limited to damages resulting from carrier delays, product availability changes, or recipient reactions to gifts.

Our total liability for any claim arising from a project is limited to the amount you paid for that specific project.

No Warranties

This website and its content are provided on an as-is basis. We make no warranties, express or implied, regarding the accuracy or completeness of the content on this site. We reserve the right to update or remove content at any time without notice.

Governing Law

These terms are governed by the laws of the State of Nevada. Any disputes arising from your use of this website or your engagement with Emboxed will be handled in the appropriate courts of Nevada.

Changes to These Terms

We may update these Terms of Service from time to time. The date at the top of this page reflects the most recent revision. Continued use of this website or engagement with Emboxed after changes are posted constitutes acceptance of the updated terms.
